Misconduct/Disciplinary or Grievance

  • Undertaking disciplinary or grievance investigations and the production of a resulting investigation report for the business. Followed, if and as required, by presentation at any subsequent Hearing or Appeal.
  • On average Richard undertakes two significant investigations each year, generally related to allegations made against senior staff where it is not possible or ideal to be investigated in-house and/or where there is not the in-house capacity or capability within the business.

Redundancy

Redundancy & Change Management (incl. TUPE):

Advice, the design & management of processes, drafting letters, facilitating meetings.

Summary of recent redundancy advice & support for an SME –

  • ­Advising over whether the number of proposed redundancies over 2 sites would require submission of HR1 and collective consultation
  • ­Checking rationale for each proposed deletion (which led to 2 positions being removed from the proposals)
  • ­Advising on process and timescales
  • Drafting proposal and consultation letter to ensure clarity of rationale and process and written to show the company is a caring and good employer
  • ­Advising on job descriptions and specs for some new positions created – incl. ensuring they do not create problems around pools of eligibility and suitable alternative redeployment
  • Advising on pools of eligibility and selection processes for the new positions
  • ­Drafting end of consultation, decisions and next steps letter
  • ­Drafting template redundancy letter
  • ­Advising on specific matters as and when required
